Canada's Anti-Spam Legislation (CASL) requires marketers to obtain consent before sending commercial electronic messages (CEMs) to recipients in or from Canada. Express consent under CASL is obtained when the recipient affirmatively opts in — verbally or in writing — and, unlike implied consent, does not expire unless withdrawn. Marketers relying on express consent must still include identification information and a functioning unsubscribe mechanism in every CEM.
